This privacy statement applies to all services that fall under Landport B.V., hereinafter referred to as: Landport, part of the Louwman Group.

1.Controller

Landport is responsible for the processing of your personal data if you as a (business) customer provide data which is considered personal data. Landport strives to provide high quality services. Reliability is an important factor in this respect. We consider respect for our customers' privacy and the careful handling of their personal data to be an important part of our services' reliability. This privacy statement contains general information about how we handle your personal data.

2. Our aim: Protection of personal data

Landport respects its customers' privacy. Landport therefore takes the protection of personal data very seriously in the performance of its activities. Personal data are handled and secured with the greatest possible care. Landport makes every effort to protect the collection, transmission and storage of personal data in accordance with the nature of such information. Landport has implemented technological solutions to protect your personal data against unauthorised access and use. If necessary, we will adjust these measures as new, generally accepted security standards or technology become available.

3. What are personal data?

As soon as data can identify you as a natural person, these data are called personal data. Examples of personal data are your name, address, date of birth and bank account number. Your IP address or user name may also be considered personal data. The information you provide to us in order to use our services may also be personal data. The same is true if you have a sole proprietorship or if your business address is also your private address.

4. Which personal data do we process concerning you?

We would like to provide you with service as good as that to which you are used to having from us. We sometimes need your personal data to ensure that you are able to use our services. Depending on the service you purchase from us, we may request among other the following company and/or perhaps personal data from you:

  • Company name
  • Company address
  • Company postal code
  • Company domicile
  • Company phone number
  • VAT number
  • For direct debit: bank account number
  • Contact person(s)
  • Telephone number of contact person(s)
  • Company general e-mail address
  • E-mail address of contact person(s)
  • Position of contact person(s)
  • Delivery address

We will use the personal data you provide only for the purposes we have previously communicated to you. You can also find more information about some of these purposes in this privacy statement.

5. For what do we use your personal data?

No sale of personal data to third parties

We would like to remain honest and transparent about the use of your personal data. The personal data that you have provided us in order to use Landport's services will be used only for the purposes set out below. We will not sell your personal data to third parties, but data may be exchanged for the indicated purposes within the Louwman Group.

Purpose and use of personal data

Your personal data are always processed on the basis of a legal basis, namely:

  • performance of a contract with you;
  • legitimate interest of Landport or a third party, such as marketing, advertising, security, (crime) prevention, IT management, research and analysis of our or the third party's own products or services, business management, legal affairs and internal management;
  • consent from you;
  • a legal obligation; or
  • performance of a task of general interest.

Below you will find an explanation of the foregoing.

As a wholesaler of batteries and related products, Landport supplies you with products. We collect and use the personal data that you have entrusted to us in order to supply you with a service or information. Landport records personal data when the purchase of a product is concluded, a service is purchased or when you contact Landport. Landport processes these personal data for the conclusion of a contract for and performance of our services and for the purposes listed below.

Prevention of fraud and abuse. Unfortunately, companies, including Landport, sometimes have to deal with incorrectly submitted claims or declarations. This does not benefit Landport or its customers. Personal data may also be used to prevent this type of abuse.

Sharing with third parties. For some services, we use third parties, who assist us in supplying the product or service you have requested, and we will consequently share your personal data with this third party. Your personal data may be passed on to other companies within the Louwman Group, or third parties, who (help to) supply the services and/or products offered. Naturally, we will make proper arrangements with these external parties concerning the careful handling of your personal data.

If you have given your explicit consent, Landport may share your personal data with the manufacturers of its products and other companies within the Louwman Group (see www.louwmangroup.nl), including Toyota Netherlands, Lexus Netherlands, Alcredis Finance, Suzuki Netherlands, Louwman Retail, Louwman Exclusive Cars, Van Dorst Automotive, Blauwendaal, Rüttchen Automotive, Auto.nl and the Louwman Museum. These companies may offer you information about their services and/or products. You may always withdraw your consent if you no longer wish this.

Improvement of the service. We use the personal data we collect through our services to provide you with the best possible service and to develop new products and services.

Improvement of the website and applications. To be able to improve our website constantly, Landport keeps (personal) data about the use of our website through cookies, web beacons and other similar technologies for storing information. Our goal is to personalise advertising and to be able to offer a better, faster and safer customer experience. We may share this information, which under certain circumstances may be personal data, with third parties who carry out anonymised analyses for us.

Relationship management and marketing. We process personal data for our relationship management and to undertake targeted marketing activities. Based on data from internal and external sources and your visit to our web pages, we can send you appropriate and targeted commercial offers, for example via post, telephone or the Internet.

Legal obligations. It is possible that we may be compelled to provide personal data to authorities or other third parties. For example, if this is necessary in connection with a legal obligation or for the performance of a task in the public interest.

Retention period. We will not retain your personal data for longer than necessary unless we have a legal obligation to retain personal data longer. We need your personal data in order to provide you with the best possible service. This also primarily determines the time limit we set for the storage of your personal data. Our basic principle is that we will only retain personal data for as long as is necessary to provide you with the service or as long as there is a legitimate interest in doing so. Thereafter, we will erase, block or anonymise your personal data.

To fulfil contractual obligations, data collected from you may be retained as long as the contract is in force and - depending on the contract's nature and scope - thereafter in order to comply with the legal retention requirements and to be able to answer any questions or resolve complaints after the contract's end.

We may retain data that we believe are necessary to assess and prevent claims against us or to initiate criminal proceedings or to prevent claims against you, us or third parties for as long as such proceedings could be instituted.

6. Security and processors

We protect your personal data stored with us. Naturally, we will do everything in our power to protect your personal data against unauthorised access, loss or theft. We have drawn up an internal policy to ensure that our products and services are designed in such a way that an appropriate level of security applies as standard. Landport employees shall have access to your personal information only if this is necessary for the performance of their duties.

We shall make arrangements for the security of your personal data that we have processed by an external party. We will ensure that any third party which we engage for our services and which processes personal data for us also satisfies our security requirements. We will do this by concluding a so-called "processor agreement" in which we will set out, among other things, agreements on the security measures to be taken and on the use of personal data.

7. Your rights and contact persons

You have the right to access the personal data we process concerning you. In addition, in some cases, you have the right to have the processing of personal data rectified, blocked or deleted. You also have the right to withdraw your consent, if our processing of your personal data is based thereon, the right to lodge a complaint with the Dutch Data Protection Authority, the right to restrict the processing concerning you and the right to data portability. The last statement means that you may transfer your personal data (or have it transferred). Please contact Landport if you would like to exercise your rights. If you have any questions about the way Landport handles your personal data, or if you wish to exercise one of your privacy rights, please contact Landport at info@landportbv.com, indicating 'Privacy Landport' in the subject line. Landport may ask you to provide (further) details about your request if it cannot or cannot fully determine to which personal data your request for access, modification or deletion relates. Landport will suspend the implementation of your request until you have provided the (further) specific details.

We last amended our privacy statement on 31 May 2018. Landport reserves the right to amend its privacy policy. Consequently, Landport advises you to check this page regularly to see if any changes have been made. We will inform you of any substantial changes to our privacy policy.
